Democrats in the fake news media continue to push allegations that Brett Kavanaugh sexually assaulted women in high school and college.
Their ultimate goal is to boot Kavanaugh from the Supreme Court or bully him into voting with the liberal Justices.
And now Brett Kavanaugh’s life could change forever because of this lawsuit.
The fallout from the New York Times fake news essay by Robin Pogrebin and Kate Kelly continues to spread.
After the Times published a fictional account of Kavanaugh’s friends putting his penis in a female student’s hand – but leaving out the fact that the woman in question did not remember the incident – many Americans demanded the fake news media pay a price for this disgraceful smear campaign.
Chief among them was President Donald Trump.
President Trump tweeted out that Kavanaugh should sue the New York Times for libel.
“Brett Kavanaugh should start suing people for libel, or the Justice Department should come to his rescue. The lies being told about him are unbelievable. False Accusations without recrimination. When does it stop? They are trying to influence his opinions. Can’t let that happen!”
The President added, “Just Out: “Kavanaugh accuser doesn’t recall incident.” @foxandfriends DO YOU BELIEVE WHAT THESE HORRIBLE PEOPLE WILL DO OR SAY. They are looking to destroy, and influence his opinions – but played the game badly. They should be sued!”
On a subsequent broadcast of “Fox and Friends,” Judge Andrew Napolitano told the hosts that even though Kavanaugh was a public figure – which makes libel suits more difficult – Kavanaugh actually had a strong case against the Times.
“Here’s an interesting one: Can Justice Kavanaugh sue The New York Times?” Napolitano asked.
“We know the standard is actual malice. Actual malice means did The New York Times publish something they knew was false, or did they publish it in reckless disregard to whether it was true or false? Is leaving out of the article the true statement that the victim does not recall this alleged event reckless disregard for the truth? He may actually have a case there. However, this is not going to happen. He doesn’t want to sue The New York Times. That’s going to open up pandora’s box for him.”
And Kelly and Pogrebin only bolstered the argument that the Times had committed libel when, during an interview on fake news CNN, they claimed the Times’ editor was to blame for omitting the fact that the alleged victim did not recall Kavanaugh’s alleged harassment.
But in the end, Napolitano does not believe Justice Kavanaugh will go through with a lawsuit.
For starters, the Times would appeal the case all the way to the Supreme Court.
That means Kavanaugh would have to recuse himself, leaving only eight Justices to decide the case.
That means there is a strong possibility the court would deadlock four to four and leave the case with no resolution.
Second of all, Kavanaugh has already won.
The American public sees the Times for what it is – an ideologically driven purveyor of fake news.
